We may delete your account and all associated data
Any outstanding payments will become immediately due
Sections of these Terms that by their nature should survive will remain in effect

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

We specifically disclaim any implied warranties of:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of data
Any warranty arising from course of dealing or usage of trade

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM TERMINAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

In no event shall our total liability to you for all damages exceed the amount you paid us in the last six months, or fifty dollars ($50) if you haven't made any payments.

You agree to indemnify, defend, and hold harmless Axiom Terminal and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date at the top of these Terms.

Your continued use of the Services after such changes constitutes acceptance of the new Terms. If you do not agree to the modified terms, you should discontinue your use of the Services.

These Terms shall be governed by and construed in accordance with the laws of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts of the state of New York.
